CLAUSULA DE RESPONSABILIDAD
En cumplimiento de la ley 679 de 2001 adicionada y modificada por la ley 1336 de 2009 (Prevención ESCNNA), rechaza la explotación pornográfica y el turismo sexual en niños, niñas y adolescentes. De igual manera en cumplimiento de las leyes 17 de 1981 (Protección Flora y Fauna silvestre), Ley 1333 de 2009 (Sanciones Ambientales), ley 63 de 1986 (Protección bienes culturales) y Ley 1185 de 2008 (Protección Patrimonio cultural) busca prevenir y rechazar actos que maltraten y atenten contra la vida de las especies animales, contra el medio ambiente y busca la salvaguardia, protección, sostenibilidad, divulgación y estímulo para los bienes de patrimonio cultural de la nación.
Cláusula de Responsabilidad: COLMUNDO VIAJES está sujeta al régimen de responsabilidad que establece la ley 300 /96.
Los precios detallados anteriormente corresponden a la información suministrada por parte de las aerolíneas, operadores terrestres y hoteles contactados al momento de realizar la cotización, y están sujetas a cambios sin previo aviso hasta tanto se realice la reserva formal y compra anticipada de los servicios.
Servicios sujetos a disponibilidad el día en que se soliciten las reservas correspondientes
Tarifas aéreas sujetas a cambio por parte de las aerolíneas sin previo aviso; solo se garantizan con la expedición de los tiquetes.
Recuerde que los tiquetes solo pueden anularse el mismo día de su expedición.
Los tiquetes tienen una vigencia máxima de un año.
Los Operadores seleccionados por COLMUNDO VIAJES, cumplirán a cabalidad con los productos y servicios que fueron contratados, a su vez velaran por el bienestar del pasajero, lo asesoraran y resolverán las dudas que se le presenten sobre los posibles tours y sitios de interés, así como también la solución de los inconvenientes que se puedan presentar durante la utilización del producto y/o servicio adquirido.
COLMUNDO VIAJES se hará responsable por falla o falta en la prestación de un servicio o reserva hotelera, si es causada más allá del control de nuestra parte, incluyendo efectos tales como accidentes, huelgas, asonadas, terremotos, condiciones climáticas, inundaciones, incendios, explosiones, actos de terrorismo, nos reservamos el derecho de hacer los cambios necesarios para garantizar el éxito del producto o servicio turístico adquirido por el cliente; En caso que el pasajero tuviese reservas efectuadas en el destino afectado y debe cambiar de destino, ciudad u hotel, correrá por cuenta y orden del mismo.
Los precios del programa están sujetos a cambios sin previo aviso por la fluctuación de monedas internacionales y sólo regirán los vigentes en el momento de expedición de los tiquetes aéreos y vouchers terrestres.
En el supuesto de producirse la cancelación total del tour y/o servicios contratados cualquiera fuese la causa invocada, incluso por motivos de enfermedad y/o fallecimiento- se efectuarán las retenciones de acuerdo con la antelación con que se efectúe la cancelación y las políticas de los proveedores seleccionados.
La agencia de viajes tiene la autonomía de modificar el itinerario o los hoteles confirmados y demás servicios, por otros de igual o superior categoría cuando dichos cambios redunden en beneficio de la calidad del viaje y la satisfacción del pasajero, también por sobreventa de los hoteles al momento de usar el servicio.
Todos los clientes o usuarios finales deben llevar en regla la documentación correspondiente, según las leyes de los países que serán visitados, será obligación del cliente obtener por su cuenta dicha documentación, en caso de que la agencia sea la responsable de suministrar la asesoría para el trámite de la visa, no asumirá la responsabilidad en caso de que las autoridades del país o países visitados nieguen al pasajero los documentos requeridos para el ingreso al destino, evento en el cual el usuario tendrá derecho al reintegro del valor de los servicios turísticos no disfrutados dependiendo de la políticas de los proveedores seleccionados para el plan adquirido .
La Agencia o proveedor seleccionado tienen la autoridad de retirar del tour a quien, por causa grave de carácter moral o disciplinario debidamente comprobada, atente contra el éxito del mismo; caso en el cual el usuario tendrá derecho al reintegro del valor de los servicios turísticos no disfrutados.
La agencia no asumirá ninguna responsabilidad frente a los asuntos legales u otros inconvenientes en que pueda verse involucrado el usuario, en caso de que el usuario se vea obligado a retirarse de la excursión por tales motivos y así mismo, frente a los gastos personales en que el pasajero incurra.
El equipaje y cualquier objeto que el turista lleve consigo es responsabilidad de este, a menos que el usuario adquiera una póliza que cubra aspectos tales como pérdida, sustracción, deterioro o daño de sus efectos personales.
Para garantizar las reservas se requiere de un depósito que definirá el proveedor seleccionado para el servicio, este será abonados a la porción terrestre Una vez entregado el depósito por el pasajero acepta las condiciones aquí estipuladas.
Una vez que el tour se haya iniciado, la no utilización de algún servicio o el abandono del mismo, no tendrá devolución alguna.
Para cada servicio se deberá investigar con el asesor si el plan es rembolsable, revisable o endosable.
Si los servicios aquí cotizados y solicitados por el cliente son de categoría baja, turista o económica aceptara que tiene conocimiento de las limitaciones en sus servicios y estructura de los mismos por lo que no aceptaremos reclamos puesto que nosotros cumplimos en hacerles conocer las condiciones del servicio y proveedores seleccionados y que son para personas que buscan una economía en su viaje o sencillamente así lo desean.
COLMUNDO VIAJES, no asume responsabilidad legal ante (a). Los gastos personales en los que incurra el usuario durante el plan turístico o el producto que haya tomado. (b). el comportamiento del usuario, así como por los inconvenientes en que pueda verse involucrado, que generen su retiro de la excursión o plan turístico, por comportamientos sancionables disciplinaria o penalmente o los que atenten contra la moral. C. Con relación al equipaje y el contenido de éste, ni cualquier objeto que lleve consigo el usuario, debido a que estos elementos, así como su seguridad son responsabilidad exclusiva de éste. (d) Por accidentes, pérdidas o daños que sufran los usuarios como consecuencia de imprudencia o inobservancia de las instrucciones que para el debido disfrute de su estancia sean efectuadas por parte de los transportadores (bus, embarcaciones o aviones) y/u hoteles. (e). Daños, pérdidas y perjuicios ocasionados por parte de los transportadores (terrestres, marítimos y/o fluviales y/u hoteles. (f). Daños pérdidas y perjuicios ocasionados por descuidos y/o negligencia del usuario.
LIABILITY CLAUSE

The services are subject to availability on the day that the reservation is requested.

The Agents selected by COLMUNDO VIAJES will fulfill the products and services hired. They will also provide for the welfare of the traveler, they will counsel and solve any doubt about tours and interesting destinations. They will also look for the solution to any inconvenient that may appear during the usage of the service or product.
COLMUNDO VIAJES assume responsibility for the lack or fail in the provision of the service or hotel reservation. If the fail is caused beyond the agency’s control including accidents, strikes, uprising, earthquakes, climatic conditions, floods, fires, explosions, terrorist actions, we reserve the right of doing necessary changes to guarantee the success of the product or tourist service acquired by the client. In case the client had reservations in the affected destination and he would had to change the city or hotel will be funded by the client.
The program prices are subject to change without prior notice because of the international currency fluctuation. The prices will be determine by the present currency on the date the airline ticket and voucher were issued.
On the assumption that we cancel the whole tour or contracted service for whatever reason, even on the ground of illness or death, we will make deductions depend on the time of the cancellation and the policies of the selected suppliers.
The travel agency has the autonomy in amend confirmed itineraries, hotels, or any other service by another one equal or with highest category when this changes were made in the interest of the travel quality and the client’s satisfaction, also because of overbooking in the moment of the service.
All the clients and final users must have all the documents required by the authorities of the country concerned; it is the costumer’s obligation to obtain these documents. If the agency is responsible of some consulting for the visa process, this will not assume the responsibility in the case the authorities don’t allow the passenger to enter the country. If this is the case, the clients are entitled to a reimbursement of the touristic service value depending on the supplier policies over the purchased plan.
The Agency or purchased supplier has the authority to deny the tour to whom threatens the success of it for serious moral reasons effectively checked. In this case the client will be entitled to reimbursement of the touristic service values that he didn’t enjoy.
The Agency will not assume any responsibility with legal issues or any other inconvenient in which the client could get involve in the case the user had to retire the excursion because of those reasons.
The tourist is responsible for the baggage or any other object he carries with him unless the client buy an insurance to cover lost, theft, or damage.
To guarantee the reservation it is required a deposit which is determined by the selected supplier for the service; this value will be added to the terrestrial part. Once the deposit is delivered by the passenger, this accept the agreed terms.
If the client doesn’t use any service or leave the tour once it has begun, there is no refund.
For each service the client should investigate if the plan is refundable, revisable or endorsable.
If the quoted services by the client are low, tourist, or economic class, he will accept to knowledge the service limitations and structure. For this reason we will not accept any claim because we let the client know about the service’s terms and conditions on their trip.
COLMUNDO VIAJES will not assume the legal responsibility on, A. client’s private expenses from the touristic plan or the product he (she) has taken. B. the conduct of the client as well as the inconvenient he (she) could get involve in, reason why he (she) can be expelled from the trip or touristic tour; any punishable behavior against the moral. C. any baggage or its content, or any other object carried by the client since all this elements and its security it’s the client’s responsibility. D. accidents, lost or damages suffer by the client as a consequence of their imprudence or disregard of the instructions given by the conveyors (bus, boats, or airplanes) or hotels. E. Damages or lost caused by the conveyors (ground, maritime or at the hotel). F. Damages or lost caused by the client’s carelessness.
